Marty Orlick's practice, encompassing more than 30 years, focuses primarily on ADA compliance, real estate transactions, and litigation. Marty is a member of the American College of Real Estate Lawyers. He serves as the Chair of JMBM's ADA Compliance and Defense Group and is the author of the ADA Compliance and Defense Blog.

He advises companies in a full range of ADA compliance issues, including compliance with architectural requirements of the ADA standards, website compliance for individuals who are blind or visually challenged, enterprise-wide policies, practices and procedures, and operator relay call effective communication training. He works with clients proactively to avoid ADA litigation and to minimize the risk and defends clients in Department of Justice and state agency investigations nationally.

Marty’s real estate transactional practice includes the purchase and sale of luxury estate properties for high-net-worth individuals, leasing, lease administration for developers and tenants, portfolio management, regulation of real property use and development, eminent domain counseling and litigation, land use regulation and permitting, code compliance, lease termination negotiations, litigation and public relations issues.

His litigation experience includes trials and arbitrations and covers a wide range of real estate matters including construction disputes, design professional liability cases, lease litigation, rent arbitrations, and ADA defense.

His clients include financial institutions, developers, shopping center owners and retailers, professional sports arenas, museums, hotels, restaurants, performing arts theaters, wineries and other business property owners.

He is a member of the American College of Real Estate Lawyers and is on the Advisory Board of Directors of the Advanced Commercial Leasing Institute.

Representative Experience

  • Represented California State Automobile Association Inter Insurance Bureau in the sale and leaseback of its corporate headquarters in San Francisco, as well as a lease/purchase option transaction for its new corporate office.
  • Represented Target Corporation in real estate transactions, land use and environmental matters.
  • Represented the former PepsiCo Real Estate, Inc.'s (now YUM! Brands, Inc.) casual dining division, including Taco Bell Corp., Pizza Hut, Inc.,KFC, CalPac Pizza, LLC in real estate transactions, litigation, operational issues, land use regulation, and eminent domain matters.
  • Serves as litigation counsel for 24 Hour Fitness USA, Inc. in a consumer contracts case involving member complaints and administrative inquiries.
  • Negotiated leases for national real estate roll-outs for The Gap, Inc., Office Depot, Score Learning Centers (a division of the Washington Post), and other retailers.
  • Oversaw and defended ADA lawsuits and represented Wells Fargo Bank's Corporate Real Estate Group in class action involving 285 branches in the Commonwealth of Pennsylvania. Resulted in compliance at a nominal cost to the bank.
  • Conducted an ADA assessment for The Living Desert, Palm Springs , one of the first to analyze an outdoor museum. This involved effective communication with visitors, access to special programs and exhibits, and interactive communication for hearing, cognitive, and visually impaired visitors.
  • Represented the Essex House, Wagner Hotel, and Walker Hotel in New York City for ADA compliance litigation. Resolve these cases for a nominal amount and minimal remediation.
  • Conducted an ADA assessment of seven hotels in New York City involving a detailed walkthrough of the hotels and public accommodations, providing ownership with list of suggested changes and assuring that the changes were made.
  • Represented Extended Stay America in punitive class actions and actions against individual hotels throughout the country involving defense of numerous alleged architectural barriers and website compliance.
  • Led comprehensive ADA assessments of the Four Seasons Hualalai and Four Season Maui hotels in Hawaii to ensure guests with disabilities can take full advantage of the hotels’ accommodations.
  • Performed inspections for golf courses to ensure their designs and operations comply with new ADA guidelines.
  • Trained USSA call center personnel on ADA compliance.
  • Conducts pre-acquisition ADA due diligence for purchasers of some of the country’s top hotels.
  • Represents the San Jose Sharks, Sacramento Kings, and other professional sports teams and museums in ADA compliance assessments.
  • Represents national and regional banks, hotels & resorts, restaurants, professional sports stadiums and retailers in ADA litigation and enterprise-wide compliance.
